These Terms of Service explain the rules for using this website and purchasing artworks, prints, and related artistic products through vMaras.art.

By visiting this website, browsing the online shop, submitting an inquiry, or placing an order, you agree to these Terms of Service and the policies referenced in them.

Please read these Terms carefully before placing an order.

vMaras.art is an artist website and online store presenting original artworks, prints, and related artistic products by Vinka Maras.

The website allows visitors to view available artworks, submit inquiries, and purchase selected artworks and products through the online shop.

3. Shopify platform

This website is powered by Shopify, which provides the online store, checkout, payment, and related technical services.

Any purchase made through this website is made directly with vMaras.art / Vinka Maras, not with Shopify.

Shopify may process certain information as part of providing the website, checkout, payment, and related services. More information is available in the Privacy Policy.

4. Use of the website

You may use this website only for lawful purposes.

You agree not to misuse the website, interfere with its operation, attempt unauthorized access, upload malicious code, scrape or copy website content, or use the website in a way that violates applicable law or the rights of others.

5. Products and artwork descriptions

I make reasonable efforts to present each artwork and product as accurately as possible, including images, dimensions, materials, descriptions, prices, and availability.

However, please note that:

Colors may appear differently depending on your screen, device, lighting, and display settings.
Original textured artworks may look slightly different in person than in photographs.
Small variations in texture, surface, finish, and color are part of the nature of original artwork.
Each original artwork is one of a kind unless clearly stated otherwise.
Availability may change if an original artwork is sold.

Product descriptions may be updated or corrected when needed.

6. Orders

When you place an order through vMaras.art, you are making an offer to purchase the selected item.

An order is accepted only when it has been confirmed and payment has been successfully processed.

I reserve the right to refuse or cancel an order where necessary, including if:

The item is no longer available
There is an error in the price or product information
Payment cannot be processed
The delivery destination cannot be served safely or reasonably
There is suspected fraud, misuse, or unlawful activity
A custom delivery arrangement cannot be agreed for a large or fragile artwork

If an order is cancelled after payment has been made, you will be refunded where applicable.

Please review your order carefully before submitting it.

7. Prices and payment

Prices are displayed in EUR, unless another currency is selected or shown by the website.

The final price, available payment methods, shipping costs, and any applicable charges are shown during checkout before the order is placed.

Payments are processed through Shopify and/or its supported payment providers.

I do not directly store or access your full payment card details.

8. Shipping, delivery, and handover

Delivery options depend on the artwork size, value, destination, and delivery risk.

For smaller works and prints, delivery may be arranged through postal or courier services.

For larger, fragile, or higher-value original artworks, standard parcel shipping may not always be available. Delivery may instead be arranged through one of the following methods:

Personal delivery by the artist, where possible
Local pickup by appointment
Tracked and insured courier delivery
Custom delivery or shipping quote agreed before dispatch

If delivery needs to be arranged individually, this will be communicated before dispatch.

Delivery times are estimates and may depend on the destination, courier, postal service, customs, weather, holidays, or other circumstances outside my direct control.

I take great care when packing artworks. However, because original artworks are one of a kind and often fragile, customers are asked to inspect the parcel and artwork carefully upon delivery.

Please keep all packaging until the issue is resolved.

9. Returns, cancellations, and refunds

Returns, cancellations, refunds, damaged items, and the EU/Croatia 14-day right of withdrawal are governed by the Return and Refund Policy published on this website.

Please review the Return and Refund Policy before placing an order.

Nothing in these Terms limits any mandatory consumer rights that may apply under Croatian or European Union law.

10. Custom artworks and personalized orders

Custom commissions, personalized artworks, special-order pieces, or artworks created specifically according to your request may be subject to different cancellation and return rules.

Where an artwork is made to the customer’s specifications or clearly personalized, the legal right of withdrawal may not apply once work has started, unless the item is defective, damaged, or not as agreed.

11. Intellectual property and copyright

All artworks, images, photographs, product photos, text, logo elements, design elements, and other creative content displayed on vMaras.art are protected by copyright and intellectual property rights, unless stated otherwise.

All rights remain with Vinka Maras.

Buying an original artwork, print, or other product does not transfer copyright or reproduction rights to the buyer.

Unless agreed in writing, the buyer receives ownership of the physical artwork or product only, not the right to copy, reproduce, publish, distribute, modify, sell reproductions, create derivative works, use the artwork commercially, or use the artwork for branding, merchandise, advertising, digital products, NFTs, AI training, or any other commercial purpose.

No artwork, image, photograph, text, logo, or other content from this website may be copied, reproduced, modified, distributed, published, used commercially, used for AI training, or used to create derivative works without prior written permission.

12. Website content

The content on this website is provided for general information, artistic presentation, and online shopping purposes.

I make reasonable efforts to keep the information accurate and up to date, but I cannot guarantee that all website content will always be complete, current, or free from errors.

To the extent permitted by law, vMaras.art is not responsible for indirect losses, loss of profit, loss of business opportunity, or other consequential losses resulting from use of the website or purchase of products.

This does not affect your legal rights if a product is damaged, defective, not as described, or not delivered as required by applicable consumer protection law.

19. Events outside reasonable control

vMaras.art is not responsible for delays or failure to perform obligations caused by events outside reasonable control, such as postal or courier disruption, customs delays, natural disasters, severe weather, strikes, technical outages, government restrictions, or other unforeseen events.

If such an event affects an order, I will contact you as soon as reasonably possible to find an appropriate solution.

These Terms of Service and the use of this website are governed by the laws of the Republic of Croatia, where applicable.

If you are a consumer located in another EU country, you may also have mandatory consumer rights under the laws of your country of residence.

Nothing in these Terms limits any mandatory consumer protection rights that apply under Croatian or European Union law.
